Posting of Content
Uploaded content such as (but not limited to) images, textual descriptions, and various Web codes and scripts, must be owned and copyrighted by the poster or in the public domain. The legal ramifications of posting such content fall solely on the party posting. Content must be composed of legal material. Examples of illegal material include child pornography, promotion of piracy, stolen goods, viri, and defamatory or misleading content. Misleading content includes spam, chain letters, and pyramid schemes. Pornographic content is allowed if a warning is given in the listing title of the content. If it is determined that copyrighted and/or otherwise illegal material has been listed at ChainMailSales, and effort will be made to remove it as soon as possible once it is determined that such rules have been violated. Content License By posting content, perpetual rights are granted to ChainMailSales for that content for use in any media for the purposes of advertising royalty-free worldwide. These rights cannot be revoked once posting takes place as such content must be used to promote goods for sale and to store all information in the ChainMailSales database. Sale of Goods It is the responsibility of both the buyer and the seller to make the final transaction following acceptance of the terms and price of the sale. The position of ChainMailSales is to advertise for the seller, not act as a mediator or escrow service. Yet, ChainMailSales will assist in reporting illegal activity to the appropriate authorities, using database records as evidence. Release from Liability By making use of any and all services of this website or its affiliates, it is agreed that ChainMailSales is released from all liability relating to the actions of others and that all risks associated with the use of said services falls solely on the parties chosing to do so. This includes the requirements for court appearances relating to disputes. However, provided that data records are required, they can be provided as evidence with written request. In addition, ChainMailSales is not liable for potential revenues lost due to temporary or permanent loss of website accessibility either relating to hosting or penalties by banning of participants who violate terms of use. In the event of a breach of security of the ChainMailSales database by a third-party, it is agreed that ChainMailSales, its owners, and its affiliates, are released from all liability concerning the incident, should it occur. If ChainMailSales is found to be liable for any reason, it is agreed that civil damages of any type will not be greater than $100US and that all court fees, attorney's fees, and associated fees, will not be the responsibility of ChainMailSales, its owners, and its affiliates. Lawfulness Any terms and conditions not covered in this agreement shall be derived from laws pertaining to the locations of residence of the buyer, seller, ChainMailSales webserver, and ChainMailSales ownership. Privacy ChainMailSales and its owners do not sell, rent, trade, or otherwise, provide any personal information to third parties for marketing material or for any other uses without consent. Information gathered is only used to display posted sales and to allow buyers and sellers to contact each other to complete a transaction. At Will Usage All usage of the services provided at ChainMailSales are considered at-will for the temporary timespan of membership. By cancelling membership, that relationship is considered to end, but all licenses, liabilities, and responsibilities, still hold for legal matters or other possible matters that may arise in the future. Updating of Terms These terms and conditions can be updated at any time, superceding all previous versions. By continuing use of ChainMailSales in the future, the updated terms will hold valid. Acceptance By using ChainMailSales for selling, buying, browing, or any other interactive means, members and non-members agree to the rules set before them with the understanding that possible legal consequences may result for breaking any of the rules. |
